Terms of Use.

These are the terms between you and BetterYou for using Echo — a body-awareness and wellness app. We wrote them in plain, direct language, with a short version at the top; the full text below it is what binds.
First — if this is an emergency
Echo is not an emergency service, and no human monitors it in real time for safety — including when Guided Support is on. If this is an emergency, contact your local emergency services immediately.
The short version — what matters most
- Echo is a body-awareness and wellness app — awareness of your body and of what happens in your physiology while things happen. Not a medical service, not treatment, not diagnosis — and not a substitute for any of them.
- The measurements from your own wearable and from the camera are an indication, not a medical measurement — and they are not guaranteed to be accurate.
- You’re talking with an AI, not a human. AI can be wrong or incomplete — don’t rely on it as fact or as qualified advice. If you turn on Guided Support, members of our team may take part behind the scenes, including shaping or composing parts of Echo’s responses (Section 07).
- Minimum age: 18.
- Your content stays yours. We take only the license needed to run the Service — not to train models without your consent.
- The weekly report leaves only when you export it and share it yourself, with whomever you decide. We do not pass it to anyone — and what has already been sent cannot be recalled.
- You can stop at any moment — and delete everything.
- The Service is free. Our liability is limited, as Section 13 sets out.
- Governing law: Israeli. Privacy: in the separate Privacy Policy.

01The agreement
These Terms are an agreement between you and BetterYou Technologies Ltd., company no. 516458957, of 146 Begin Road, Tel Aviv (“BetterYou”). Installing, registering for, or using Echo (the “Service”) constitutes agreement to these Terms and to the Privacy Policy, which is an integral part of them. These Terms govern Echo only; other BetterYou products are governed by their own terms. If you do not agree — do not use the Service.
02What the Service is
Echo helps you develop awareness of your body and its physiological responses. Throughout use, physiological and textual data is processed and a guiding conversation with an artificial-intelligence system accompanies you: Echo reads the measurements your own wearable device already records, which reach Echo through the health-data connection you approve on your phone; during a session, the camera can read further measurements from your face using remote photoplethysmography (rPPG); the system marks points in time that deserve attention; you decide what is meaningful and put it into your own words — on your own or in conversation with the system — so you can notice and reflect; and from all of this, a summarizing personal picture and tailored content are built. Part of the product’s purpose is for that picture to be yours outside the app too: you can export a weekly report from it and share it yourself (Section 08).
Echo also offers Guided Support, an optional feature you turn on: members of our team, bound by confidentiality, may work behind the scenes in your sessions, only with your separate, explicit consent. Section 07 and the Privacy Policy describe it. We may update and improve the Service from time to time.
03What the Service is not
Echo is not a medical service and is not treatment. BetterYou does not provide healthcare or mental health services, and does not practice medicine, psychology, diagnosis, or therapy. THE SERVICE IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION. Use of the Service does not constitute or create a doctor-patient, therapist-patient, or any other healthcare professional relationship — or a professional relationship of any other kind — between you and BetterYou.
Echo does not diagnose and does not make medical recommendations. Everything in the Service — including measurements, moments, maps, songs, and messages — is FOR INFORMATIONAL PURPOSES ONLY; none of it is medical advice, a diagnosis, or a treatment recommendation, and it must not be relied on as such. For any medical or mental-health question, consult a qualified professional or your doctor. Do not delay seeking qualified advice, and do not stop treatment, because of something you saw in Echo.
The app is not a medical device and is not intended to detect, monitor, or prevent any medical condition. Your wearable is a third-party device we neither make nor control, and nothing in Echo turns the measurements it produces into medical measurements. The system cannot detect emergencies or acute distress, does not alert anyone to them, and is not built to respond to them — do not rely on it in such situations.
Guided Support changes none of this. The members of our team involved in it are not clinicians and provide no care; their involvement does not create a doctor-patient, therapist-patient, or any other professional relationship between you and them or between you and BetterYou, and it does not make Echo a healthcare service. Guided Support does not add safety monitoring. Even with Guided Support on, no one is watching for emergencies or crises; the involvement is not continuous and must never be relied on in an emergency.
04Eligibility and age
The Service is intended for people 18 and over. By using it, you confirm that you are at least 18, that you have the legal capacity to enter into this agreement, and that the details you provided are true and current.
05Your account
Keep your login details confidential; you are responsible for activity in your account until you notify us of suspected unauthorized use. If you suspect unauthorized use — tell us immediately at team@betteryou.tech. The account is personal and cannot be transferred.
06The band: accuracy limits
Physiological measurement outside a clinical setting is subject to well-known limitations. Your wearable is your own third-party device, which we neither make nor control, and the measurements it produces reach Echo through the health-data connection you approve; their quality depends on the device itself, on signal quality, on how it is worn, on movement, and on individual characteristics. For camera-based measurement (rPPG): lighting, movement, distance from the camera, and individual characteristics including skin tone. The measurements in the Service (heart rate, HRV, sleep, moment detection) — whether they come from your wearable or from the camera — are not guaranteed to be accurate, complete, or continuous. They are meant to invite you to notice and reflect — not to establish facts.
07Conversations with AI
Conversations in the Service are held with an artificial-intelligence system. Apart from Guided Support, described below, no human takes part in them and no human monitors them in real time. This technology is still developing and may produce wrong, inaccurate, or incomplete answers, including “hallucinations”. Do not rely on a factual statement by the system without independent verification, and do not treat what it says as qualified advice. The system phrases things as invitations (“we noticed that…”) and does not make determinations about you. You can report an inappropriate or concerning AI response directly from the conversation; reports reach our team without exposing the rest of your conversation.
If you turn on Guided Support, members of our team may review your sessions — as they are, not anonymized — or take part in shaping Echo’s responses, as described in the Privacy Policy. Their role is the quality of Echo’s guidance, never safety monitoring.
08Exporting and sharing your report
You can export a weekly report from the app as a file — a filtered summary of your personal picture, with no conversation transcripts. Export happens only on your initiative, and you share the file yourself — outside the app — with anyone you choose. Sharing is 100% your decision: what to share, when to share, and with whom. BetterYou does not transfer the report to any third party — not automatically and not in any other way — and no third party is registered to receive data from the system. Beyond the subprocessors we use to operate the Service and disclosures required by law — as detailed in the Privacy Policy (Sections 07 and 11) — we do not transfer data to any third party on our own initiative.
What happens to the file after it leaves is your responsibility. We do not control it, we do not know who you gave it to, and we cannot know what is done with it. “Un-sharing” a file that has been sent is impossible: it cannot be recalled, and deleting your account with us does not delete copies that already left. Once you direct your report to a third party, that third party’s own privacy practices will govern how it is handled — BetterYou is not a party to that and is not responsible for it.
09Your content stays yours — the Service stays ours
Your content stays yours. You grant BetterYou a limited, non-exclusive, revocable license to process your content solely to operate the Service for you and to secure it. Any use of content to improve the system or train models happens only in accordance with the anonymous-contribution toggle in the Privacy Policy — not under a blanket license. When you delete your account, the license ends.
The Service itself — our code, design, marks, and content — is the property of BetterYou or its licensors. You receive a personal, limited, non-commercial license to use the app.
10Prohibited uses
- Unlawful, harmful, or harassing use, or violating the rights of others.
- Reverse engineering, copying, scraping, data mining, or automated access to the Service.
- Commercial use, or selling or renting access, without our written consent.
- Circumventing security measures, or attempting to access another user’s data.
- Using the Service on behalf of another person without their knowledge and consent.
11Subscription and payment
The Service is provided free of charge, and there are no payments in the system and no collection of payment details. If paid components are ever offered, these Terms will be updated in advance, prices will be shown before any purchase, and you will be asked for renewed agreement.
12Stopping and termination
You may stop using the Service at any time and delete your account and your data. We may suspend or terminate access for a material breach of these Terms, with notice where possible, and may discontinue the Service as a whole with reasonable advance notice — which will include the option to receive a copy of your data in a usable format, as set out in Section 10 of the Privacy Policy (separate from the weekly-report export under Section 08 of these Terms).
13Liability and indemnification
To the extent permitted by law, the Service is provided free of charge and “as is”, without any warranty. We do not undertake that the Service will be available without interruption, or that it will be free of errors or faults.
To the extent permitted by law, BetterYou will not be liable for indirect or consequential damage, including loss of data, loss of profit, or damage to reputation, arising from use of the Service or from inability to use it. Our total aggregate liability for direct damage, for all claims together, will not exceed ILS 1,000.
Nothing in this Section limits liability for bodily injury, for wilful misconduct, or for anything else that cannot be limited under applicable law. You will indemnify BetterYou for damage it actually incurs as a result of your breach of these Terms, to the extent the damage was caused by you. We will tell you of any such claim promptly and will not settle it without your agreement.
14Law, jurisdiction, changes and general provisions
These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction lies with the competent courts in the Tel Aviv district. Nothing in these Terms takes away mandatory rights you have as a consumer under the law that applies to you, including any right to bring proceedings in the courts of your own place of residence where that law gives you one.
Changes: we will update these Terms from time to time. Before a material change takes effect we will notify you in the app, and where the change requires it we will ask you to accept the updated Terms. For non-material changes, continued use after the update means acceptance. If a provision is found unenforceable, it will be replaced by the closest enforceable one in spirit, and the remaining provisions stand.
Assignment, notices, entire agreement: we may assign these Terms as part of a merger, acquisition, or transfer of our business, and we will tell you if we do; you may not assign your rights or obligations under them. Notices to you are given in the app or by email; notices to us go to team@betteryou.tech. These Terms and the Privacy Policy are the entire agreement between us about the Service.
15App store terms
This agreement is between you and BetterYou — not with Apple and not with Google. Apple and Google are not responsible for the Service, for its content, for its maintenance or support, or for any claim relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and are entitled to enforce them against you. Your use of the Service must also comply with the terms of service of the app store you obtained it from. BetterYou — not Apple — is solely responsible for addressing any claim that the Service, or your use of it, fails to conform to a legal or regulatory requirement or infringes a third party’s intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not listed by any government as a prohibited or restricted party.
